A Florida Court Order on Emergency Executive Action: Case Notes

Note: This post discusses a specific Florida court order from 2020 and is preserved here as a case study in emergency executive action and judicial review.

The attached Order was entered today by Second Judicial Circuit Judge Charles Dodson. In pertinent part, the Order enjoins and restrains the Florida Department of Education from penalizing any school or district that chooses not to reopen brick and mortar options. The end of the Order strikes the provisions of the Florida Department of Educations’ Order requiring all schools reopen, or lose financial funding.
